Welcome to the Napperon online sales site. When you make a purchase on this platform, you automatically accept its terms and conditions of sale. Consequently, we recommend that you read the information below carefully before ordering an item on the platform.
  1. Applications of the conditions of sale
These general terms and conditions of sale are concluded between the company Napperon, registered under the siret number 90330685000012, hereinafter referred to as the “seller”, and any natural or legal person wishing to purchase the products “products” offered for sale via the website napperon.fr, hereinafter referred to as the “customer”.
Any order duly validated on the site www.hopaal.com implies full and unreserved acceptance of these general conditions of sale.
These conditions of sale shall prevail over any other general or specific conditions not expressly agreed to by the seller.
Given possible developments of the Site and regulations, the seller reserves the right to modify its conditions of sale at any time. In this case, the applicable conditions will be those in force on the date of the order by the customer.

  1. Site information and accessibility

www.napperon.fr is an e-commerce site owned and operated by the company Napperon.
 
The Site is accessible to all users of the Internet network in principle 24/24h, 7/7d, except for interruption, scheduled or not, by Napperon or its service providers, for the needs of its maintenance and/or security or in cases of force majeure (as defined below).
 
Napperon cannot be held responsible for any damage, whatever its nature, resulting from unavailability of the Site.
 
Napperon does not guarantee that the Site will be free from anomalies, errors or bugs, nor that the site will operate without breakdown or interruption. In this regard, it may freely determine at its sole discretion any period of unavailability of the Site or its content.
 
Napperon cannot be held responsible for data transmission problems, connection or network unavailability.
  1. Products
The products offered are on the site napperon.fr. The products offered for sale are as follows: unique and semi-custom-made lingerie pieces made to order from old doilies, net curtains and embroidered tablecloths. Each doily ready to be transformed is accompanied by a description and photographs that are as faithful as possible but cannot ensure a perfect similarity with the product. Napperon is committed to choosing doilies of the best possible quality, however due to the vintage and second-hand nature of the products, some may be subject to wear and tear over time. All lingerie pieces are made in the Basque Country in Anglet and Urcuit.
The products offered for sale are those described on the site on the day the customer consults the site, within the limit of available stocks. These details are automatically updated in real time. However, an error in the update, whatever its origin, does not engage the responsibility of Napperon. As such, Napperon cannot be held responsible for the cancellation of an order for a product due to the exhaustion of stocks. Please note that in most cases the placemats are unique and a placemat = one or two pieces on average, everything will always depend on the size of the latter.
  1. Rates
The prices indicated on the napperon.fr website are inclusive of tax in euros but do not include shipping costs.
The seller reserves the right to modify its prices at any time. However, it undertakes to invoice the goods ordered at the price indicated when the order is registered.
  1. Ordering process
The customer who wishes to place an order must follow the following procedure:
  • The customer chooses his model and size
  • Once the model and the right size have been selected according to availability, the customer chooses their placemat. The customer agrees to provide their measurements or the measurements of the person for whom this product is intended with precision (a precise guide is provided for this purpose on each product page and in the “Help” tab, “Take your measurements”.) This information is essential to allow the design of the desired product in semi-custom form and to allow the customer to have a unique piece in the right size.
  • Checking the contents of the selection: the customer checks the contents of their basket while retaining the possibility of deleting the products they have selected.
  • Identification: the customer must complete the identification form made available to them and provide the requested information (mandatory information: title, surname, first name, address, date of birth, email, telephone number for delivery).
  • Order verification: the customer checks the contents of his order, the total price, the delivery and billing addresses while keeping the possibility of deleting a product or modifying the billing and delivery address. He chooses his payment method and must confirm his acceptance of these general conditions of sale by checking the corresponding box. Validation of the order is only possible after checking this box.
  • Acknowledgment of receipt of the order: the customer receives an email summarizing the contents of his order, namely:
- the order number;
- the list of products ordered;
-delivery terms;
-the present general conditions of sale.
It is advisable to keep and print this document, official proof of the order. The order is then recorded and processed by Napperon, which checks the availability of the product(s) ordered. Any order placed implies acceptance of the prices and descriptions of the products available for sale. Napperon undertakes to honor orders received on its website only within the limits of available stocks. In the event of unavailability of the products ordered or a placemat that is too small for the measurements given, Napperon will contact the customer by e-mail as soon as possible, in order to advise of the terms of cancellation or refund of the order.
Once the order is validated, the selected product goes into production: each product is made to order, no product is made in advance. The time between the validated order and the sending of the package is 3 to 4 weeks maximum.
Confirmation of sending the order: the customer receives an e-mail confirming the sending of his order. The contract is deemed to be concluded on the date of sending this e-mail.
Order tracking: The customer will receive an email with the tracking number of their package. It is also possible to track orders in the customer area.
  1. Payment
In order to ensure the security of payments, the site www.napperon.fr . uses the Stripe secure payment service. This service integrates the SSL security standard. Confidential data (the 16-digit bank card number, the expiration date and the visual cryptogram) are directly transmitted encrypted on the Stripe server without passing through the physical media of the server www.napperon.fr . Payment cards accepted via Stripe are: CB, MasterCard®, American Express®.
The customer can also make his payment by Paypal Express.
Payments made on the site are debited in €.
  1. Delivery
The order will be shipped within 4 to 5 weeks (validation of the order, production and shipping). Once the package has been shipped, the customer will receive a tracking link.
Napperon delivers to countries in the European Union and Switzerland. Napperon specifies that neither delivery costs nor customs taxes are included in the prices of the products and are therefore the responsibility of the Customer.
 
Delivery costs are those applied by Colissimo and Mondial Relay, depending on the delivery method chosen.
The customer receives, via the email confirming the shipment of his order, the tracking number assigned to the package allowing him to follow the delivery process of his order.
Delivery is made to the delivery address indicated by the customer, it being specified that this must be the customer's residential address or that of a natural or legal person of their choice. It is the customer's responsibility to provide the exact and complete information necessary for the proper routing of their order and perfect delivery (such as, in particular: street number, building number, staircase number, access codes, names and/or intercom numbers, etc.).
Delivery is deemed to have been made upon the Order being made available to the Customer by the carrier. The control system used by the carrier shall be deemed authentic.

In the event that Delivery cannot be made due to an incorrect delivery address, given the unique and semi-custom nature of each piece, a reshipment may take place, at the customer's expense.
Napperon cannot be held responsible for delays in delivery that are not its fault or justified by a case of Force Majeure.
In the event of the delivery time being exceeded, the customer may write to lesdessousnapperon@gmail.com to request the status of the delivery and agree on a reasonable additional delivery period. If the customer has not received his order at the end of this new reasonable delivery period, he can cancel the sale by writing to lesdessousnapperon@gmail.com and obtain within a maximum period of 14 (fourteen) days the reimbursement of all sums paid on the occasion of the Order, via the means of payment used during the Order.
 
  1. Withdrawal
​Given the customizable and unique nature of orders placed on the Napperon website, Article L.121-20-12 of the Consumer Code does not apply. The customer does not have 14 days to return the item without a specific reason. However, returns and credits are provided under certain conditions, see the following paragraph provided for this purpose.
  1. Returns, credits and alterations

a. The customer does not like the transformed part

If the customer does not like the transformation of the placemat, a return is possible. The return or exchange of items will only be accepted if the request has been validated by customer service and only if the items ordered are returned in perfect condition, unused or damaged. Shipping costs will be borne by the customer.

A credit or refund may be possible.

All requests must be made no later than 8 days after receipt of the package.


b. The size of the room does not suit the customer.

If the size of the part does not suit the customer, a return is possible. The return or exchange of items will only be accepted if the request has been validated by customer service and only if the items ordered are returned in perfect condition, unused or damaged. Shipping costs will be borne by the customer.

A retouch, credit or refund may be possible.

To request a retouch, refund or credit: the customer can send an email to lesdessousnapperon@gmail.com 

All requests must be made no later than 8 days after receipt of the package.


When validated by customer service, the return of the products is the responsibility of the buyer and we cannot be held responsible for any delivery problems with the carrier you have chosen. We recommend delivery of the package against signature.


Legal guarantees

The products sold benefit from the legal guarantee of conformity provided for by articles 211–4 et seq. of the Consumer Code and the guarantee of hidden defects (articles 1641 et seq. of the Civil Code). These guarantees cover hidden defects and apparent defects from the date of delivery. The only obligation incumbent on Napperon under this guarantee is, at its choice, the free replacement or repair of products recognized as defective without any other service or compensation.
This warranty does not cover damage resulting from improper use of the product, normal wear and tear due to its use or failure to follow washing and maintenance instructions. To benefit from the product warranty, it is essential to keep the product purchase invoice and delivery note.
The presence of an apparent defect on a product must give rise to a complaint by e-mail (lesdessousnapperon@gmail.com). Any complaint must explain the defect concerned. Failing this, no complaint is admissible, and no return or exchange is possible.
 
The product must be returned, in its original packaging, with the references of the initial order and a copy of the complaint to the head office of Napperon, after sending an e-mail reporting the apparent defect of the product referred to above.
 
Cases of apparent defect give rise, depending on the content of the customer's complaint, to either the establishment of a credit note for the customer's benefit or to the outright reimbursement of the customer within 14 (fourteen) days.
In the event of non-compliance with the return procedure, no exchange, refund or credit is possible.
  1. Responsibilities
The seller's liability may not be implemented if the non-performance or delay in the performance of one of its obligations described in these general terms and conditions of sale results from a case of force majeure. As such, force majeure means any external, unforeseeable and irresistible event within the meaning of article 1218 of the Civil Code.
The seller's liability may also not be implemented in the event of disruption or total or partial strike of postal services.
Furthermore, Napperon cannot be held responsible for any direct or indirect damage that may result from access to the Site or use of the Site and/or its information, including its inaccessibility, loss of data, deterioration, destruction or viruses that may affect the Client's computer equipment and/or the presence of viruses on the Site.
 
Napperon strives to provide reliable content on the Site. However, and despite all its efforts, the seller cannot guarantee that the Site is free from inaccuracies or omissions and Napperon cannot be held responsible for errors or omissions, or for a lack of availability of information and services.
  1. Intellectual property
 
All elements of the site napperon.fr, including the brand name “Napperon” and its logo, are and remain the intellectual and exclusive property of the seller. Napperon is also the exclusive owner of the domain name “napperon.fr”. The reproduction or representation, in whole or in part, of the pages, data and any other constituent element of the site www.napperon.fr, by any process or medium whatsoever, without the prior written authorization of Napperon, is prohibited (with the exception of copies for private use and those made for the needs of the press) and constitutes an infringement punishable by the Intellectual Property Code, likely to incur the civil and/or criminal liability of its author.
 
  1. Protection of personal data
The customer is informed and accepts that his personal data may be collected on the site via the Shopify platform and used by Napperon, which acts as data controller within the meaning of Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (hereinafter "General Data Protection Regulation" or "GDPR").
Napperon undertakes to protect and ensure the security and confidentiality of its customers' personal data in accordance with the GDPR, in particular by taking all useful precautions to prevent this data from being distorted, damaged or accessed by unauthorized third parties. It is specified that the Site is hosted by Shopify, which provides Napperon with an online e-commerce platform for selling products and that the Customer's personal data is stored via Shopify's data storage, its databases and the general Shopify application.
In the event of a personal data breach, Napperon shall notify the CNIL of the breach in question as soon as possible. If the personal data breach is likely to result in a high risk to a customer's rights and freedoms, Napperon shall inform the person concerned of the personal data breach as soon as possible.
 
Customers' personal data is collected for the following purposes:
  • order management and customer relations;
  • customer information relating to offers and commercial information relating to the brand;
  • strengthening and improving the communication of the website and the brand by sending, in particular, newsletters and special offers based on customer preferences observed on the site;
  • compliance with legal and regulatory obligations.
 
Napperon does not store the customer's personal data; it is only kept for the period strictly necessary for the purposes set out above.
In accordance with the GDPR, the customer has the right to access, rectify and oppose personal data concerning him/her (hereinafter the "Data Protection Rights"). To exercise one or more of the Data Protection Rights, the customer must send a request by email via lesdessousnapperon@gmail.com or by unsubscribing directly from the newsletter.
Each request must be signed and accompanied by a photocopy of an identity document bearing the customer's signature and specify the reply address. The response to the request made on the basis of one or more Data Protection Rights will be sent within 2 months of receipt of the request.
The customer may communicate to Napperon specific instructions in which he or she defines the manner in which he or she intends that the Data Protection Rights and Freedoms be exercised after his or her death in accordance with the GDPR.
 
  1. Cookies
 
When consulting the site, information relating to customer browsing may be recorded in “cookie” files installed on their terminal (computer, tablet, smartphone).
 
These cookies are issued in order to facilitate navigation on the site and make it possible to recognize customers' browsers when they are connected to the site.
 
Cookies are only installed after acceptance by the customer, continued browsing on the site being deemed acceptance.
Most browsers automatically accept cookies, but the customer can choose at any time to accept or not cookies from his browser settings, often located in the "Tools" or "Preferences" menu of his browser.
 
Any settings implemented by the customer may negatively affect their user experience and parts of the site may no longer be accessible in their entirety.
  1. Applicable law, disputes
These T&Cs are subject to French law.
 
In the event of a dispute, the customer will contact Napperon as a priority to seek an amicable solution by contacting Customer Service via email at lesdessousnapperon@gmail.com

Any dispute will fall under the exclusive jurisdiction of the Bayonne commercial court, in the absence of an amicable agreement between the customer and Napperon.
